Terms and Conditions

We welcome you to enter Kalashree Art. These terms and conditions govern your use of the website, products, services, and the purchase of artwork. By accessing or using our website and purchasing any goods, you express your consent to be bound by these terms. Should you disagree with any part of this Agreement, we further request that you refrain from using our website. These terms might be updated, changed, or modified from time to time at our sole discretion without further notice. All updates become effective once posted on our website.

1. Preface

By using the Kalashree Art site, you are deemed to have the capacity to enter into enforceable contracts. You have to ensure that you use our website in accordance with all laws and regulations. Any variation of misuse would immediately suspend our web access with no recourse.

We reserve the right to modify or discontinue any content or services offered on the website without prior notice. We do not accept any responsibility for interruptions or errors in service.

2. Product Information & Availability

With all due efforts put forth to ensure the accuracy of product details such as pricing, descriptions, images, and availability, these may contain occasional errors. We cannot assure you that every detail in such documentation will always be correct or up to date.

In the event of any discrepancy, whether with respect to stock availability of products or otherwise, Kalashree Art reserves the right to cancel/change/refuse an order at its sole discretion. Should we be unable to fulfil an order because the goods ordered are out of stock, we shall nevertheless give you prompt notice and provide you with a substitute or offer a refund.

3. Order Acceptance and Pricing

All orders are deemed valid only when Kalashree Art confirms and accepts them. Although we do make every effort to offer accurate pricing on all products, we shall have the authority to cancel or adjust pricing in case of ordering mistakes, such as an incorrect price being displayed.

If your order is accepted, an order confirmation will be sent to you. However, this does not mean that the item is guaranteed to be in stock or delivered until you have sent in a full payment and have that payment processed.

4. Payment Terms

Payments are accepted through credit and debit cards, online payment gateways (such as PayPal), and bank transfers. Before we ship your Product, we require full payment. By providing your payment information, you confirm that you are authorized to use that particular payment method. If your order cannot be processed due to technical problems or insufficient funds, we will inform you that we have cancelled the order.

5. Shipping and Delivery

Shipping costs are determined according to size and weight, and a geographical zone or location is involved. After confirming any payment, the product will be shipped as soon as possible. In India, this should take about 8-10 days, but it could stretch to 15-18 days or more to reach foreign destinations. Kalashree Art shall have no liability for delays arising from – but not limited to – late shipping carriers, delays in customs clearance, or incorrect information concerning the delivery address.

6. Returns, Refunds, and Cancellations

If you are not happy with your purchase, we will accept returns within 7 days of receiving the Product, provided it is not damaged or altered from the time of delivery. Returns must receive prior approval before sending the item back; the cost of returns is borne by the buyer.

For cancellations, you may request to cancel your order within 24 hours of purchase. Refunds will be processed once the Product has been received and inspected. Please note that custom or personalized artworks are non-returnable unless they are damaged during transit.

7. Intellectual Property

All contents, including images, designs, text, logos, and artwork on the Kalashree Art website, are the sole property of Kalashree Art and are protected by the copyright laws in existence. You cannot copy, reproduce, distribute, or use any content in any other medium without having obtained our written permission to do so in advance.

Any unauthorized use of the content found on the website is strictly prohibited. Legal action will be pursued against violators.

8. Limitation of Liability

Kalashree Art shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our website or products. We do not warrant or guarantee that our website will be free from errors or that it does not contain viruses or any other harmful components.

Our maximum liability to you in any claim arising on your order, Product, or service shall under no circumstances exceed the money you have paid for that particular order.

9. Privacy and Security

We value your privacy. We are committed to keeping your personal data safe and secure. Our Privacy Policy describes what information we collect from you, how we use it, and how we protect your information. By using this site, you consent to the collection and use of your data in accordance with our Privacy Policy.

All payments are made via safe payment methods using SSL encryption to secure your financial information. We do not keep your payment details on our server.

10. Children’s Privacy

Kalashree Art does not knowingly collect or solicit personal information from anyone under 13. If we learn that we have collected personal information from a child, we will take steps to delete that information. If you believe that we have collected personal information from a child, please contact us immediately.

11. Copyrights

The copyrights of all artwork, including the digital representation of the artworks sold through our website, remain the property of the respective artist unless otherwise specified. Buyers are granted limited rights to display the purchased artwork for personal use only. Any commercial use, reproduction, or distribution of the artwork is prohibited without prior consent from the artist or Kalashree Art.

12. Governing Law

These Terms & Conditions are governed by the laws of India. Any disputes arising from the use of this website or related to our products will be resolved in the courts of India.

13. Modification of Terms

Kalashree Art reserves any right to change or modify any terms and conditions at any time. Further, it is always prudent to review the terms regularly to see if any changes have been made. Use of the Website thereafter will be deemed acceptance of the terms, as amended.
